Terms & Conditions

These are the standard terms and conditions for Website Design and Development and apply to all contracts and all work undertaken by FX Web Studio.

Payment Terms: A 50% deposit of the total fee is required before we commence any design and development work. The remaining 50% shall become due when the work is completed to your reasonable satisfaction and must be paid in full before the launch of the site. We reserve the right not to commence any work until the deposit has been paid in full.

Supply of Material: You must supply all materials and information required by us to complete the work in accordance with any agreed specification. Such materials may include, but are not limited to, photographs, written copy, logos and other printed material. Where there is any delay in supplying these materials to us which leads to a delay in the completion of work, we have the right to extend any previously agreed deadlines by a reasonable amount. Where you fail to supply materials, and that prevents the progress of the work, we have the right to invoice you for any part or parts of the work already completed.

Project Delays and Client Liability: Any time frames or estimates that we give are contingent upon your full co-operation. During development there is a certain amount of feedback required in order to progress to subsequent phases. It is required that a single point of contact be appointed from your side and be made available on a daily basis in order to expedite the feedback process.

Variations and Revisions: We are pleased to offer you the opportunity to make revisions during the design phase. However, we have the right to limit the number of revisions to a reasonable amount and may charge for additional changes if you require changes ouside of the original specification.

Data Entry and Product Uploads: Data entry of products is not included in the above packages and therefore will be quoted separately according to the number of products required.

Licensing and Ownership of Website: Once you have paid us in full for our work we grant to you a license and ownership to use the website and its related contents for the life of the website.

Ownership of Domain Name: Any domain names registered on your behalf will be registered in your name and will be made available to you upon full payment of fees.

Web Hosting: As part of your website package we offer you 12 months free web hosting commencing from the setup of any email or web services. Once the free period has expired, your will be invoiced 12 months in advance at $28 p/m. Failure to pay web hosting on time may result in suspension of email or web services.

We do NOT outsource our work to any other company, whether overseas or in Australia. We do ALL of our work IN-HOUSE and we do NOT want to hear from you about your services.

According to the Australian Spam Act 2003, you are NOT permitted to email me without my consent. You can read the fact sheet about spam - issued by the Australian Government. If you proceed to forward your email to us, we will proceed with the following:

  • Lodge an official complaint with the Australian Communications & Media Authority.
  • Report your email address as spam to Gmail, Outlook.com (Hotmail) and Yahoo! Mail.
  • Report your server's IP address to over 100 blacklists.
